ainava.eu PURCHASE TERMS

In order to avoid unnecessary delays and disagreements during the conclusion of the purchase agreement, please familiarize yourself with and accept the most important terms and conditions of purchase of goods offered by SIA "RC Ainava", unified registration number 43202005939 (hereinafter referred to as ainava.eu).

1. The sale of goods offered by ainava.eu takes place through an offer placed on the Internet, in accordance with Article 10 of the Consumer Rights Protection Law of the Republic of Latvia (PTAL), in which case, when the buyer places an order, a Distance Contract is concluded between the buyer and the seller.

2. All prices of goods on ainava.eu are indicated including Value Added Tax 21%. The offered prices are valid for the period indicated for the goods. The costs of the goods delivery service are not included in the indicated price of the goods.

3. You can pay for the ordered product and the selected delivery service using a bank transfer, internet banking, or with a payment card (ONLINE). It is also possible to pay in cash or with a payment card upon receipt of the product at the RC Ainava Sia store at Pils Street 15, Alūksne (only for products marked “available immediately”).

4. When placing an order, it is necessary to provide an e-mail address so that the customer can be sent instructions, an invoice-delivery note, etc. necessary documents.

5. When ordering a product, we offer you to choose one of the following ways to receive the product: the cheapest delivery method is free - the ordered product is received at the RC Ainava Sia store at Pils Street 15, Alūksne, economic delivery - the ordered product is received at a parcel machine at one of the largest shopping centers in Latvia, comfort delivery - a courier company delivers the ordered product to the specified address. The delivery time of the product is indicated on the product card, or is agreed upon during the order process.

6. The ordered product must be received within three to five business days from the moment ainava.eu announced that the order is ready for receipt.

7. Before starting to use the purchased product, please carefully read the product's instructions for use and use the product only in accordance with its manufacturer's instructions, in accordance with the product's properties and intended purposes.

8. If you have changed your mind and decided to refuse the purchase, the Consumer Rights Protection Law of the Republic of Latvia (PTAL) and the regulatory Cabinet of Ministers Regulation No. 255 "Regulations on Distance Contracts" (Cabinet of Ministers Regulation No. 255) stipulate that the buyer has the right to withdraw from the contract within 14 calendar days and return the product purchased in the online store back to the seller. The buyer must inform ainava.eu of the decision to withdraw from the distance contract and return the goods by filling out the Withdrawal Form and contacting us by e-mail: [email protected] or by phone: +37122019936 indicating the order number and date. ainava.eu is obliged to refund all payments made by the buyer as soon as possible, but no later than 14 calendar days after receiving the information. The money is returned to the same account from which it was transferred to the company's account. Buyers' applications, where a different account than the one from which the money was transferred to the company's account has been indicated, are accepted, but we warn that the money will be returned to the account number that appears in the bank statement (from which the money was received), and not to the one that appears in the customer's application. The exception is if the customer has paid for the purchase with cash or a bank card in the store, as well as in other cases when the customer's bank account is unknown.

ainava.eu informs that the buyer loses the right of withdrawal in the following cases:

• If excessive use of the goods is established. Article 12, Part 11 of the PTAL states that excessive use of the goods is established, namely, a case where the goods have been used more than is necessary to determine the nature, properties and operation of the goods. In general, the buyer has the right to use the goods for inspection purposes to the extent that it is usually possible to do so in a regular store.

• If the buyer has made inappropriate use of the goods. Article 12, Part 6 of the PTAL states that when withdrawing from a distance contract "the consumer is responsible for maintaining the quality and safety of the goods during the period for exercising the right of withdrawal". We recommend that you keep the original packaging of the goods so that when exercising the right of withdrawal in accordance with the provisions of the Distance Contract, the goods are not externally mechanically damaged. In cases where the buyer has used the goods inappropriately within the period of the right of withdrawal, for example, has soiled, damaged, or otherwise raised suspicions that the goods do not comply with health and hygiene requirements, the seller is entitled to take action against the buyer, including, if necessary, in court.

9. Complaints received about the quality of the goods will be resolved in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (PRPL), in accordance with the regulatory Cabinet of Ministers Regulations No. 631. “Procedures for filing and examining a consumer claim regarding a good or service that does not comply with the terms of the contract” (Cabinet of Ministers Regulations No. 631).

10. We remind you that the PPL norms do not apply to cases where the goods were purchaseds legal entities.

11. In compliance with the legislative norms of the Republic of Latvia, ainava.eu retains purchase contracts concluded with buyers in the amount necessary for accounting, contracts concluded with leasing companies are retained by the relevant leasing companies.

12. ainava.eu reserves the right to unilaterally cancel the order in cases where it is not possible to sell the product to the customer. The following situations are considered cases:

• If the product is sold out and it is no longer possible to order it from the supplier's warehouse,

• If an inappropriate price is indicated for the product due to a system error,

• Other technical errors.

The customer is informed about the cancellation of the order by e-mail, SMS or telephone. In cases where the buyer has already paid for the product, the money will be refunded within 14 calendar days.

13. Marketing activities:

13.1. ainava.eu is free to initiate various marketing activities, including loyalty programs.

13.2. By agreeing, I agree to receive ainava.eu notifications in my e-mail in the "Ask about availability" section, the client automatically signs up to receive news by e-mail from ainava.eu.

14. If you want to opt out of receiving news by e-mail, send an e-mail with the text "I want to opt out of receiving ainava.eu news and special offers" - to the e-mail [email protected] ; changes in the system occur within 24 hours.

15. If you are a registered user of ainava.eu, but for some reason you want to delete your profile, please write to [email protected]

16. The online store ainava.eu reserves the right not to process the order if the online store fails to contact the client by the phone number or e-mail specified by him.

17. Payment:

17.1. It is possible to pay for goods and services in EUR currency.

17.2. The maximum order amount that can be paid in cash via courier is €1000.

17.3. The maximum amount of a single order is €10000.

17.4. If you choose to pay for an order with a bank payment card, please familiarize yourself with the daily payment limits of your bank card before paying.

17.5. It is possible to pay for goods and services in the store at Pils Street 15, Alūksne in cash and with a bank payment card.

17.6. When choosing the delivery method to receive at the pickup point at Pils Street 15, Alūksne LV-4301, it is possible to pay for the order only by prepayment. The exception is the case if at the time of placing the order, all goods in the cart are marked “available immediately”. In such cases, it is possible to pay for the order upon receipt in cash or by payment card at the ainava.eu store at Pils Street 15, Alūksne.

17.7. The order can be paid for immediately online using VISA and MASTER CARD. Payment is secure, your data is protected by an SSL certificate.

17.8. It is possible to pay for goods and services in the online store by bank transfer after receiving the invoice to the e-mail address you provided. After paying the invoice, the customer is sent a delivery note, which is valid without a signature.

18. Use and confidentiality of data entered by ainava.eu.

18.1. ainava.eu informs that by providing your e-mail address, you agree that it is included in the database and that a notification/reminder about initiated but unfinished product orders may be sent to it.

18.2. By using the website www.ainava.eu, you agree that ainava.eu or any third party acting on behalf of ainava.eu may collect and store data that allows you to track and count:

18.2.1. the total number of visits to websites,

18.2.2. the number of visitors to each specific website,

18.2.3. the domain names of visitors' Internet service providers,

18.2.4. IP addresses,

18.2.5. other data, the purpose of which is to use for system administration purposes, as well as to control the use of ainava.eu and organize its improvement.

18.3. ainava.eu is entitled to transfer the collected and accumulated data to other companies for informational purposes and statistical purposes. DATA THAT WOULD ALLOW THE IDENTIFICATION OF A PERSON IS NOT DISCLOSED IN THIS PROCESS AND IS NOT TRANSFERRED TO THIRD PARTIES.

18.4. ainava.eu does not link the user's IP address and e-mail address with data that allows identifying this user. This means that each user session will be registered, but the user of the website will remain anonymous.

18.5. All materials sent or entered on the website www.ainava.eu become the property of ainava.eu, which SIA "RC Ainava" as the owner of the website www.ainava.eu is entitled to use for its own purposes, with the exception of personal data.

18.6. Please note that by providing your e-mail address or sending any information to the website www.ainava.eu, you agree that ainava.eu is entitled to use this data only for the above-mentioned purposes.

19. DATA SECURITY

ainava.eu ensures the protection of data of customers of the online store ainava.eu in accordance with the laws and regulations in force in Latvia. ainava.eu has taken all necessary data protection measures to ensure the security of personal data and prevent its unjustified use, as well as its access to third parties.

19.1. Information obtained about customers using the ainava.eu website is processed in accordance with the purpose of data collection. The information obtained is used to be able to provide the customer with the information requested by him, as well as to enable us to provide services such as delivery of goods, identification of the buyer, etc.

19.2. As part of the quality control of the website, the following information is processed about visitors to the ainava.eu website:

19.3. The customer has the right to request that his existing data be supplemented, corrected, as well as to terminate data processing or delete customer data if they are outdated, incomplete, or not necessary for the initial purpose of collection. The buyer, upon submitting a written reasoned request, is entitled to receive the following information:

• For what purpose is the customer data collected

• Information on whether the data is processed automatically or by a natural person

• How long will the customer data be stored

• When was the last time the customer data was updated
